The key terms that guide how Miller Landscaping plans, prices, and delivers landscaping and outdoor construction projects across the Wasatch Front.
Scope of services
Miller Landscaping provides landscaping and outdoor construction services, including but not limited to design, grading, excavation, retaining walls, hardscapes and pavers, concrete, pools and pool landscaping, fencing, and full landscape installation across the Wasatch Front.
Each project is defined by a written estimate or proposal that outlines the scope of work, materials, pricing, and any specific inclusions or exclusions. If there is ever a conflict between this page and a signed project agreement, the signed agreement will control for that project.
Estimates, proposals, and changes
Initial estimates are based on the information available at the time of the visit and may change if conditions differ from what was reasonably visible or disclosed (for example, hidden utilities, soil conditions, drainage issues, or structural concerns).
Any material changes to the scope of work, design, or materials will be discussed with you. Additional work or upgrades may require a revised estimate or a written change order before we proceed.
Scheduling and site access
We schedule projects as efficiently as possible, but actual start and completion dates may vary due to weather, site conditions, material availability, and other factors outside of our control.
You agree to provide reasonable access to the property, including gates, driveways, and areas where equipment and materials must be staged. You are responsible for keeping pets and children away from active work areas for their safety.
Utilities and existing conditions
We expect all underground utilities to be properly located and marked through the appropriate service before excavation or digging begins. You agree to inform us of any known private lines (such as irrigation, low-voltage wiring, or drain lines) that may not be located by standard utility marking services.
We are not responsible for damage to underground utilities or structures that were not reasonably visible, marked, or disclosed before work began. If unexpected conditions are discovered, we will discuss options and any associated costs with you before proceeding.
Payments
Payment terms, including deposits, progress payments, and final balances, will be outlined in your estimate or project agreement. In general, work may require a deposit to secure materials and scheduling, followed by progress payments as specific milestones are completed.
Late or missed payments may delay work or result in a pause on the project until the account is brought current. We reserve all rights and remedies available under applicable law for unpaid balances.
Materials and substitutions
We use materials that are appropriate for the project and climate. Occasionally, specific products or exact colors may be unavailable or discontinued. In those cases, we will recommend comparable alternatives and discuss them with you before making a substitution.
Natural materials such as stone, plants, and wood will have natural variation in color, texture, and growth, which is expected and not considered a defect.
Plants, lawns, and living materials
Plants, sod, and other living materials require ongoing care after installation, including watering, fertilizing, pruning, and seasonal maintenance. We will install these materials in a healthy condition and can provide general care guidance, but their long-term success depends on proper care after the project is complete.
We are not responsible for damage or loss caused by drought, overwatering, pests, disease, severe weather, pets, or lack of maintenance.
Warranties and limitations
We stand behind our workmanship on hardscape and structural elements for a reasonable period after installation, as described in your estimate or project agreement. If an issue arises that appears to be related to our installation, please contact us as soon as possible so we can review it.
We do not provide warranties on materials beyond what is offered by their manufacturers, and we cannot guarantee outcomes that are affected by factors outside our control (such as soil movement, extreme weather, or changes made by others after our work is complete).
To the fullest extent permitted by law, our liability to you for any claim related to our services is limited to the amount you paid us for the specific work giving rise to the claim.
Use of the website
The content on this website is provided for general information about our services and past work. It does not create a contract by itself. A project relationship is formed only when both parties agree to and sign a specific estimate or project agreement.
We try to keep information on the site current, but details may change over time. You should confirm any critical details directly with us.
Limitation of liability for website use
We do not guarantee that the website will be error-free or available at all times. To the fullest extent allowed by law, Miller Landscaping is not liable for any indirect, incidental, or consequential damages arising from your use of the site.
Changes to these terms
We may update these Terms of Service from time to time to reflect changes in how we work or in legal requirements. When we do, we will update the “Last updated” date at the top of this page.
